Nautix Capital operates as a capital advisory firm. We provide consultation and guidance to help businesses identify appropriate financing solutions. We do not make lending decisions, extend credit, issue loans, or fund any transactions.

Submission of an application or funding inquiry does not guarantee approval, funding, or any specific terms. Any offer you receive will come directly from a lender and will be governed entirely by that lender's terms, conditions, and requirements.

Our services are intended exclusively for businesses and business owners seeking commercial financing for business or investment purposes. By using our services, you represent and warrant that:

• 02You are authorized to conduct business on behalf of the entity seeking financing.
• 03The financing you seek is for commercial, business, or investment purposes only.
• 04You are not seeking financing for personal, family, or household purposes.

Nautix Capital does not offer, arrange, or broker owner-occupied or consumer residential mortgage loans.

You agree to provide accurate, current, complete, and not misleading information when using our services. You represent and warrant that all information submitted is true, accurate, and complete to the best of your knowledge.

You authorize Nautix Capital and its lending partners to verify any information provided through sources including, but not limited to, credit bureaus, bank verification services, business information databases, and public records.

By submitting an inquiry through Nautix Capital, you expressly authorize Nautix Capital, at your request, to facilitate introductions to capital providers and service providers in our network as part of our advisory engagement. Nautix Capital is a capital advisory firm and is not a lender; we do not originate, underwrite, approve, deny, or fund credit. Introductions are not lending decisions and do not guarantee that any provider will engage, approve, or fund.

You acknowledge that capital providers we introduce you to, at your request, may contact you directly via telephone, email, or mail regarding the introduction or transaction at hand. SMS opt-in data and consent are never shared with capital providers or any third party; capital providers may only contact you by SMS under consent the consumer separately gives them. You further acknowledge that each capital provider operates under its own terms, conditions, and privacy policy, and that Nautix Capital is not responsible for the actions, decisions, or practices of any capital provider.

By submitting your information, you authorize Nautix Capital and our lending partners to obtain consumer and/or business credit reports as necessary to evaluate your financing request. These inquiries may include "soft pulls" (which do not affect your credit score) or "hard pulls" (which may affect your credit score), depending on the product, stage of application, and lender requirements.

You understand that multiple lenders may conduct credit inquiries, and that you are authorizing such inquiries by submitting your application.

By providing your telephone number, you expressly consent to receive phone calls from Nautix Capital and/or our lending partners at the number provided. These calls may be made using an automatic telephone dialing system (autodialer), artificial or prerecorded voice, or other automated technology. SMS/text messages will be sent only by Nautix Capital and only if you have separately opted in to SMS communications; our lending partners do not send SMS messages to consumers. Communications may include intake confirmation, document requests and reminders, appointment scheduling, updates on introductions to capital providers, and confirmations of materials shared or provider responses. Nautix Capital is a capital advisory firm and does not make lending decisions; messages will not include loan approvals or funding confirmations. Such calls may be made using an automatic telephone dialing system or an artificial, prerecorded, or AI-generated voice, including calls placed by Chloe, Nautix Capital's AI assistant, and may be recorded and transcribed. Consent to receive such calls is not a condition of receiving any service. You may revoke consent at any time by asking us to stop calling, and you can cancel the SMS service at any time by texting STOP as described in Section 7.

You understand that consent is not a condition of obtaining services or financing. Standard message and data rates may apply. You may revoke SMS consent at any time by replying STOP to any text message, by calling us, or by emailing sales@nautixcapital.com.

By opting in to SMS communications from Nautix Capital, you agree to the following terms:

• 01Nautix Capital uses SMS only for administrative and customer-care messages related to a user’s inquiry and engagement with our advisory team (intake confirmation, scheduling/rescheduling, document requests, and updates that a provider meeting has been scheduled). No loan offers, quotes, approvals/denials, underwriting updates, rate/term discussions, or funding confirmations are sent via SMS. SMS consent is collected separately from email or other communication consent. SMS opt-in data and consent are never shared with capital providers, affiliates, or any third party.
• 02You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
• 03If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to sales@nautixcapital.com or (843) 994-2746.
• 04Carriers are not liable for delayed or undelivered messages.
• 05As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

While we work, at your request, to introduce you to capital providers in our network that may fit your situation, we do not guarantee that any provider will engage, approve, or fund. Nautix Capital is an advisory firm and not a lender; all lending decisions are made solely by the capital provider based on its own underwriting criteria and requirements.

You acknowledge that receiving pre-qualification, conditional approval, or a term sheet does not guarantee final approval or funding. Final approval and funding are subject to satisfactory completion of the lender's underwriting and documentation requirements.

Nautix Capital does not charge application fees or upfront costs to applicants for our advisory services.

Compensation Disclosure: We may receive compensation from lenders in the form of commissions, referral fees, or other consideration upon successful funding of your transaction. This compensation is typically paid by the lender and does not increase your cost of financing. All lender fees, rates, closing costs, and terms will be disclosed to you by the lender prior to closing.

You are responsible for reviewing and understanding all fees and costs associated with any financing you accept directly with the lender providing such financing.

All content on this website, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of Nautix Capital or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any content from our website without our prior written consent.

We do not warrant that our services will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any information provided through our services is accurate, complete, or current.

We are not responsible for the conduct, practices, or policies of any lender or funding partner. Any financing terms, rates, or products offered by lenders are subject to the lender's sole discretion and applicable laws.

You agree to indemnify, defend, and hold harmless Nautix Capital, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) any misrepresentation or breach of warranty made by you; (d) your provision of false, fraudulent, or misleading information; or (e) your violation of any rights of another party or any applicable law.

Any dispute, claim, or controversy arising out of or relating to these Terms, our services, or your relationship with Nautix Capital (collectively, "Disputes") shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules.

Arbitration shall take place in Pinellas County, Florida, or another mutually agreed location. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Pinellas County, Florida.

We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

No waiver by Nautix Capital of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and Nautix Capital with respect to your use of our website and services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
