1. Services

Nautix Capital operates as a business funding advisory firm. We provide consultation and guidance to help businesses identify appropriate financing solutions. We do not make lending decisions, extend credit, issue loans, or fund any transactions.

Submission of an application or funding inquiry does not guarantee approval, funding, or any specific terms. Any offer you receive will come directly from a lender and will be governed entirely by that lender's terms, conditions, and requirements.

2. Eligibility

Our services are intended exclusively for businesses and business owners seeking commercial financing for business or investment purposes. By using our services, you represent and warrant that:

  • You are at least 18 years of age.
  • You are authorized to conduct business on behalf of the entity seeking financing.
  • The financing you seek is for commercial, business, or investment purposes only.
  • You are not seeking financing for personal, family, or household purposes.

Nautix Capital does not offer, arrange, or broker owner-occupied or consumer residential mortgage loans.

3. Information Accuracy and Fraud Warning

You agree to provide accurate, current, complete, and not misleading information when using our services. You represent and warrant that all information submitted is true, accurate, and complete to the best of your knowledge.

WARNING: Providing false, fraudulent, or misleading information may result in immediate termination of services, denial of funding, civil liability, and potential referral to law enforcement authorities for prosecution. Loan fraud is a federal crime.

You authorize Nautix Capital and its lending partners to verify any information provided through sources including, but not limited to, credit bureaus, bank verification services, business information databases, and public records.

4. Consent to Share Information

By submitting a funding inquiry or application through Nautix Capital, you expressly authorize and consent to us sharing your personal and business information with our network of vetted lenders, funding partners, and service providers for the purpose of evaluating your financing request and presenting you with potential offers.

You acknowledge and agree that these lenders and funding partners may contact you directly via telephone, email, text message, or mail regarding financing opportunities. You further acknowledge that each lender operates under its own terms, conditions, and privacy policy, and that Nautix Capital is not responsible for the actions, decisions, or practices of any lender.

5. Credit Inquiries and Authorization

By submitting your information, you authorize Nautix Capital and our lending partners to obtain consumer and/or business credit reports as necessary to evaluate your financing request. These inquiries may include "soft pulls" (which do not affect your credit score) or "hard pulls" (which may affect your credit score), depending on the product, stage of application, and lender requirements.

You understand that multiple lenders may conduct credit inquiries, and that you are authorizing such inquiries by submitting your application.

6. Telephone Consumer Protection Act (TCPA) Consent

By providing your telephone number, you expressly consent to receive calls and text messages from Nautix Capital and/or our lending partners at the number provided. These calls and messages may be made using an automatic telephone dialing system (autodialer), artificial or prerecorded voice, or other automated technology. Communications may include information about your funding inquiry, application status, and related services.

You understand that consent is not a condition of obtaining services or financing. Standard message and data rates may apply. You may revoke this consent at any time by replying STOP to any text message, by calling us, or by emailing [email protected].

7. SMS/Text Messaging Terms

By opting in to SMS communications from Nautix Capital, you agree to the following terms:

  1. This campaign will send out transactional messages related to your funding inquiry, application status, and services you have requested from Nautix Capital. These messages may include application updates, document requests, funding confirmations, and account notifications sent to customers who have opted in to receive these types of messages.
  2. You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
  3. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to [email protected] or (843) 994-2746.
  4. Carriers are not liable for delayed or undelivered messages.
  5. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

8. No Guarantee of Funding

While we strive to match you with appropriate financing options, we do not guarantee approval of any application, the availability of funding, or the terms of any financing offer. All funding decisions are made solely by lenders based on their own underwriting criteria and requirements.

You acknowledge that receiving pre-qualification, conditional approval, or a term sheet does not guarantee final approval or funding. Final approval and funding are subject to satisfactory completion of the lender's underwriting and documentation requirements.

9. Fees and Compensation

Nautix Capital does not charge application fees or upfront costs to applicants for our advisory services.

Compensation Disclosure: We may receive compensation from lenders in the form of commissions, referral fees, or other consideration upon successful funding of your transaction. This compensation is typically paid by the lender and does not increase your cost of financing. All lender fees, rates, closing costs, and terms will be disclosed to you by the lender prior to closing.

You are responsible for reviewing and understanding all fees and costs associated with any financing you accept directly with the lender providing such financing.

10. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of Nautix Capital or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any content from our website without our prior written consent.

11. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We are not responsible for the conduct, practices, or policies of any lender or funding partner. Any financing terms, rates, or products offered by lenders are subject to the lender's sole discretion and applicable laws.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NAUTIX CAPITAL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, ANY FINANCING OBTAINED THROUGH OUR REFERRALS, OR ANY ACTIONS OR DECISIONS OF LENDERS.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED FIFTY DOLLARS ($50.00).

13. Indemnification

You agree to indemnify, defend, and hold harmless Nautix Capital, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) any misrepresentation or breach of warranty made by you; (d) your provision of false, fraudulent, or misleading information; or (e) your violation of any rights of another party or any applicable law.

14. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to these Terms, our services, or your relationship with Nautix Capital (collectively, "Disputes") shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules.

Arbitration shall take place in Pinellas County, Florida, or another mutually agreed location. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

CLASS ACTION WAIVER: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST NAUTIX CAPITAL.

15. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Pinellas County, Florida.

17. Changes to Terms

We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Severability

If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Waiver

No waiver by Nautix Capital of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and Nautix Capital with respect to your use of our website and services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
